Terms of Service

These Terms govern your use of the EQI Caribbean platform. Please read them before you create an account or submit a request. By creating an account you confirm that you have read, understood and agreed to them. If you do not agree, please do not use the platform.

1. About EQI Caribbean

The EQI Caribbean platform is operated by Project 3 Consultants and Logistics Inc., a company incorporated in Barbados under Company Registration No. 52770, trading as EQI Caribbean (Technology) ("EQI Caribbean", "we", "us", "our", "the Operator"). Our registered office is #42 Durette Gardens, Gemswick, St Philip, Barbados.

EQI Caribbean is a technology platform only. We are not an insurer, an insurance broker, a lender, a credit provider, a financial adviser or any form of financial intermediary. We do not issue policies, bind coverage, assess risk, make credit decisions, approve or decline applications, or handle premiums, repayments or deposits. No payment is made on this platform at any stage.

These Terms apply to the platform at my.eqicaribbean.com and all related subdomains (the "Platform"), and to both routes available through it.

2. One platform, two routes

You hold a single EQI Caribbean account. From it you may take either route:

3. Definitions

Consumer
An individual using the Platform to submit a request and receive Indicative Responses.
Insurer
A licensed insurance company that receives and responds to requests through the Platform.
Broker
A licensed insurance broker that receives requests and may act on a Consumer's behalf.
Lender
A licensed bank, credit union, finance company or other credit provider that receives and responds to credit applications through the Platform.
Provider
An Insurer, Broker or Lender.
Request
A structured insurance enquiry or credit application submitted through the Platform.
Indicative Response
A non-binding, estimated premium, rate or set of terms submitted by a Provider in reply to a Request. An Indicative Response is not an offer capable of acceptance in law and creates no contract of any kind.
Response Window
The period during which Providers may reply to a Request, as set out in clause 6.
Account
A registered user account on the Platform.

4. Eligibility

To use the Platform as a Consumer you must:

Not every territory is open at all times. Territories are activated progressively as licensed Providers join. The territories currently open are shown when you register.

Your territory Your Request is shown only to Providers licensed in the territory you registered under. You are not matched with Providers in other territories, and Providers cannot see Requests from territories in which they are not active.

Providers must in addition hold all licences, registrations and approvals required by the relevant regulatory authority in each territory in which they operate. Provider access is governed additionally by the Provider Agreement.

5. Your account

When you register you agree to:

Multi-factor authentication is required on every sign-in. You must not attempt to disable or work around it. We may suspend or close any Account we reasonably believe has been compromised or is being used in breach of these Terms.

6. How the Platform works

6.1 Submitting a Request

You complete a structured Request giving accurate risk or application information, and you select which licensed Providers in your territory may receive it. Before your Request is submitted you are asked to give your explicit consent to your information being shared with those Providers. Nothing is sent until you give it.

6.2 Where your Request names another person

Some Requests name another individual, for example an additional driver or a joint insured. Where yours does, you confirm that each such person is aware their details are being submitted and shared with the Providers you select, and has given you their permission. You must not name a person without their permission.

6.3 The Response Window

Providers have two business days from submission to reply with an Indicative Response. Weekends do not count toward this period: the window pauses over Saturday and Sunday and resumes on the next business day. The time remaining is shown on your Request. When the window closes, no further responses can be submitted. A Provider is under no obligation to respond, and it is possible to receive no responses at all.

6.4 Reviewing and accepting

You may review every Indicative Response you receive and accept any one of them, or none. Accepting notifies that Provider that you have chosen them, and they will contact you directly to take matters forward. Everything after that point, including formal application, underwriting, documentation, terms and payment, is between you and the Provider directly.

6.5 How long you have to accept

Each Indicative Response carries a validity date set by the Provider, which is at least 14 days from the date you submitted your Request. You may accept a Response at any time while it remains valid, even after the Response Window in clause 6.3 has closed. A Provider may offer a longer validity period but never a shorter one. Once every Response you have received has passed its validity date, no Response on that Request can be accepted.

6.6 Sealed responses and no ranking

Responses are sealed. No Provider can see the pricing or terms submitted by any other Provider. We do not rank, score, weight, promote or endorse any response over another, and responses are presented to you in a neutral format. We receive no commission and no per-response fee, so we have no financial interest in which Provider you choose.

6.7 The nature of an Indicative Response

Nothing on this Platform binds anyone Every Indicative Response is a non-binding estimate. No insurance contract is formed and no credit is granted through the Platform. Cover is bound, and credit is advanced, only when a formal agreement is executed directly between you and the Provider, under the Provider's own terms, subject to their own underwriting or assessment, and in accordance with applicable law. A Provider may decline to proceed after giving an Indicative Response.

7. Your obligations as a Consumer

You agree to:

Inaccurate or incomplete information will produce responses that do not reflect your actual circumstances. A Provider may decline to proceed, or may later void an agreement, on that basis. That is a matter between you and the Provider.

8. Providers

Providers using the Platform agree to:

Where a Broker submits a Request on behalf of a client who approached them directly, the Broker confirms that they hold that client's permission to do so and that the client has been told how their information will be used.

Provider access is governed additionally by the Provider Agreement. If these Terms and the Provider Agreement conflict, the Provider Agreement prevails in respect of the commercial relationship.

9. Acceptable use

You must not use the Platform to:

10. Your information

We process your personal information in accordance with our Privacy Policy and our Data Protection Notice, both of which form part of these Terms. Please read them. They set out precisely what each Provider can see, when, and what rights you have.

We are committed to compliance with the Barbados Data Protection Act 2019-29 and with applicable data protection law in every territory in which we operate. We never sell, rent or trade your personal information.

11. Intellectual property

All software, design, systems, content and documentation on the Platform belong to Project 3 Consultants and Logistics Inc. or its licensors, and are protected by applicable intellectual property law. You may not reproduce, distribute, modify or create derivative works from any of it without our prior written permission.

You keep ownership of the information you submit. By submitting it you give us a limited licence to use it to operate the Platform and deliver the service you have asked for.

12. Disclaimers and liability

12.1 No advice

Nothing on the Platform is insurance advice, credit advice, financial advice or a recommendation to buy any product. We do not assess suitability. You should take independent professional advice before making any insurance or borrowing decision.

12.2 Availability

We aim to keep the Platform available at all times but do not guarantee uninterrupted access. We may suspend it for maintenance, updates or reasons beyond our control.

12.3 Providers

We are not responsible for the accuracy of any Indicative Response, for any act or omission of any Provider, or for any decision a Provider makes. Any dispute about cover, premiums, rates, claims, credit terms or a Provider's conduct is a matter between you and that Provider.

12.4 Limitation

To the fullest extent permitted by law, our total liability to you in connection with the Platform, whether in contract, tort or otherwise, shall not exceed the greater of the fees you have paid us in the twelve months before the claim, or BDS $500. We are not liable for any indirect, consequential or special loss. Nothing in these Terms limits liability for fraud, or for death or personal injury caused by our negligence.

The Platform is free for Consumers, so for a Consumer this limit is BDS $500.

13. Suspension and closure

We may suspend or close your Account and access to the Platform if:

You may close your Account at any time by contacting support@eqicaribbean.com. Closing your Account does not release any obligation you already owe us. What happens to your information on closure is set out in the Privacy Policy.

14. Changes to these Terms

We may update these Terms from time to time. Where a change is material we will email registered users at least 14 days before it takes effect. Continuing to use the Platform after that date means you accept the updated Terms. The current version is always available at my.eqicaribbean.com/terms/.

15. Governing law and disputes

These Terms are governed by the laws of Barbados. Any dispute that cannot be resolved informally is subject to the exclusive jurisdiction of the courts of Barbados.

To raise a concern, please contact us first at support@eqicaribbean.com. We aim to acknowledge every complaint within two business days and to resolve it within 14 days.

16. General

If any provision of these Terms is found unenforceable, it will be modified to the minimum extent needed to make it enforceable and the rest will continue in full force. A failure by either party to exercise a right does not waive it. These Terms, together with the Privacy Policy, the Data Protection Notice and, for Providers, the Provider Agreement, form the entire agreement between us about your use of the Platform.
